The service
Notideus is an email platform provided by DUKIFY INC, a company registered in Delaware, USA ("we", "us"). It gives you an API and a dashboard for transactional email and marketing broadcasts, plus templates, sending domains, contact management, and delivery analytics.
These terms are the agreement between you and DUKIFY INC. By creating an account or using the service, you accept them. If you use Notideus for a company, you confirm you are authorized to bind that company, and "you" means that company.
How we handle data while providing the service is covered by our Privacy Policy.
Accounts
You must register with accurate information and keep it up to date. One account can have a team: you can invite members, and you are responsible for what they do in your account.
API keys are secrets. Keep them out of client-side code and public repositories, scope them to what each integration needs, and revoke any key that leaks. You are responsible for everything sent with your keys. If you suspect your account or a key has been compromised, tell us at support@notideus.io immediately.
Acceptable use
Notideus exists to send email people want. You may not use it for spam: no unsolicited bulk email, and no purchased, rented, or scraped recipient lists. Marketing broadcasts go only to contacts who gave you permission to email them, and every broadcast must include a working unsubscribe link (our hosted unsubscribe pages and unsubscribe API handle this for you).
We watch bounce and complaint rates because they drive deliverability for everyone on the platform. If your bounce rate stays consistently above 5%, or your complaint rate goes above 0.1%, we may review your account and, where needed, suspend your sending. These are policy thresholds applied by our team after review — the platform does not cut you off automatically — and we will normally warn you before we act.
You may not send content that:
- is illegal, or promotes illegal activity, under any law that applies to you or your recipients;
- is fraudulent, deceptive, or designed to phish;
- contains malware, viruses, or links to them;
- is hateful, harassing, or threatening;
- infringes someone else's intellectual property or privacy rights.
We may refuse delivery of any email that breaches this section, and repeated or serious breaches are grounds for termination under "Suspension and termination" below.
Quotas and fair use
Each plan includes a monthly email volume: 5,000 emails on Free, and the volume you pick on paid plans. One API call to one recipient counts as one email; a broadcast to 500 contacts counts as 500 emails. Transactional email is priced by volume; marketing is priced by contacts and includes unlimited broadcasts to your list.
We never cut off your sending. If you go over your plan's volume in a month, the extra emails are billed at a flat $0.75 per 1,000 emails on your next invoice. Plan limits and prices are on the pricing page.
"Unlimited" features (domains, team members, broadcasts) are subject to fair use: use them for your own sending, not to resell or share the service with third parties.
Billing
Paid plans are billed monthly in advance through Stripe. The Free plan needs no credit card and stays free. Upgrades apply immediately; downgrades take effect at the end of your current billing cycle. There is no annual lock-in — you can cancel anytime.

Prices exclude taxes. Where the law requires it (sales tax, VAT, GST), we add the applicable tax to your invoice; otherwise taxes on your purchase are your responsibility. If a payment fails, we will retry and notify you before suspending paid features.
Suspension and termination
We may suspend your account or sending if you breach these terms — in particular the acceptable-use rules — or if you do not pay. We will normally warn you and give you a chance to fix the problem first, except where the breach is serious or urgent (spam, fraud, security risk), where we may act immediately.
You can close your account at any time from the dashboard or by writing to us. On termination, your right to use the service ends, we stop billing you, and your data is handled as described in the Privacy Policy. Sections that should survive termination — billing owed, intellectual property, liability, indemnification, and governing law — survive.
Intellectual property
You own your content: the emails you write, the templates you build, and the contact data you upload. You grant us only the limited right to process and transmit that content as needed to operate the service for you — to render templates, send emails, and show you analytics. We claim no other rights over it.
We own the service itself: the API, the dashboard, our brand, and the software. These terms give you a right to use the service, not ownership of it.
Warranties and liability
We work hard to keep Notideus fast and reliable, but the service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all other warranties, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that every email will reach the inbox; delivery also depends on factors outside our control, like recipient mail servers and your sending practices.
To the fullest extent the law allows, neither of us is liable to the other for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim arising from these terms or the service is capped at the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in this section limits liability that cannot be limited by law.
Indemnification
You will defend and indemnify DUKIFY INC against claims, damages, and expenses (including reasonable legal fees) brought by third parties that arise from your content, the emails you send, your contact lists, or your breach of these terms or of applicable law — including anti-spam and data-protection laws such as CAN-SPAM and the GDPR. We will tell you promptly about any such claim and let you control the defense, as long as you do not settle in a way that admits fault on our part without our consent.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute arising from them or from the service is subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and both of us consent to those courts.
Changes and contact
We may update these terms as the service evolves. We will post the new version here, update the date at the top of the page, and give you advance notice by email or in the dashboard before material changes take effect. If you keep using the service after the changes apply, you accept them; if you do not, you can close your account under "Suspension and termination".
